City faces lawsuit regarding Edgewater approval

The battle over the redevelopment of the Edgewater hotel continues as area residents Fred Mohs and Eugene Devitt filed a lawsuit Thursday in hopes of stopping the project.

The lawsuit requests the Dane County Circuit Court to overturn the certificate of appropriateness granted by the City Council for the redevelopment. This certificate is required for the project because the Edgewater property resides in the Mansion Hill Historic District.

According to the Wisconsin State Journal, the lawsuit filed by Mohs and Devitt claims the council failed to apply the correct rule of law, acted arbitrarily and made a decision to reverse the Landmarks Commission, which was not supported by substantial evidence.
