A Wisconsin Second Amendment advocacy group plans to file a lawsuit against Madison Metro Transit regarding a policy that bans weapons on city buses, according to an organization representative.
Wisconsin Carry, Inc. President and Chairman Nik Clark said state pre-emption statutes prevent cities from implementing gun laws more strict than state statutes, and the state does not prohibit concealed carry on mass public transit.
The organization wanted to give Metro Transit an opportunity to address the issue outside of court, but the bus company, which maintains the law is legal, said Friday it is not going to change its position.
Clark said the rule is “unenforceable” because of the pre-emption statutes.
“The fact of the matter is Madison shouldn’t be able to pass a law that state statute doesn’t allow,” Clark said.
Additionally, the weapons ban on city buses disproportionately affects people of lower socioeconomic status because they are more likely to utilize mass transit, according to Clark.
Clark said the organization will file its lawsuit in the next couple of weeks.
