Wellstein receives six months in jail

The first man banned from the entire UW-Madison campus was sentenced to nearly six months in Dane County Jail Monday after pleading no contest last Wednesday to three charges against him. 

As required by the sentencing, Albert Wellstein, a 52-year-old UW-Madison alumnus, will serve time for resisting a police officer and misdemeanor bail jumping in May 2007, and for violating a harassment restraining order banning him from the UW-Madison campus in September 2007. 

 

The university was granted the restraining order against Wellstein in June 2007, which barred Wellstein from campus until 2011. He was arrested during an event at the Red Gym Sept. 19 in violation of the injunction. 

According to court documents, Wellstein exhibited a number of harassing behaviors against multiple individuals connected to UW-Madison since January 2004, which contributed to the restraining order.  

 

Wellstein's attorney, Michael Covey and prosecutor Timothy Kiefer entered a joint recommendation for Wellstein's sentence Monday. 

 

Kiefer detailed the recommendation, which included a sentence of four months for resisting an officer, four months for bail jumping and two months for violating the harassment order, in addition to court costs. 

 

He said the four-month sentences would be served at the same time and the two-month sentence would be served immediately after, for a total of six months.

Because Wellstein served 59 days in jail following the incidents in May and September, he was credited for the previous jail time and was sentenced to six months in jail minus the 59 days. 

 

Dane County District Judge Stuart Schwartz said he believed the joint recommendation offered by the attorneys was fair and appropriate under all of the circumstances.  

 

Wellstein was also given 60 days to pay all court costs. 

 

He respectfully complied with the judges sentencing and denied any further comment. 

 

Before the court was adjourned, Kiefer said he had thought that one of the victims of the restraining order would attend Monday's hearing to make a statement but the victim was unable to attend.
