The Badgers weren't the only ones getting lucky during the Sept. 1 Washington State game. Two intoxicated fans were caught with their pants down in a Camp Randall restroom, arrested and appeared in Dane County court Monday.
The of-age pair, who were arrested and ejected from the game for reportedly having sex in a women's restroom, had their original citations dropped to disorderly conducts Monday and were released from court after signing signature bonds.
Under the bonds, each may no longer enter Camp Randall or drink at anytime anywhere while the case is still going on, which could last two to three months or more, according to Assistant District Attorney Mike Verveer.
City of Oregon Police Officer Gerard Pehler, who is trained to work Camp Randall on game days, became aware of the situation when he was tending to a person suffering from heat exhaustion in the upper deck at the Sept. 1 game.
A female bystander approached Pehler and asked him if he could do anything about two people having sex in the women's restroom, according to a police report written by Pehler. He said the bystander said They're going at it pretty good,"" while pointing to a restroom outside sections JJ and KK.
Pehler did not go into the restroom and instead asked a female concession stand supervisor to enter and confirm two people were engaging in sex. Pehler said the woman heard the two and warned them an officer would enter if they did not stop.
The individuals did not follow the woman's orders, so Pehler then entered the restroom and found the two, a male and a female, in the same stall.
""They were both pulling up their pants, of what I could observe, and I asked them quite loudly to get out of the stall,"" Pehler said in the report.
The two were asked to present their football tickets. The male gave over his, but the female could not locate hers while trying to button and zip her pants, which turned out to be inside out.
Police identified the male as a non-UW student in his twenties from Grant County and the female as a non-UW student in her twenties from Madison.
Pehler arrested both for lewd and lascivious behavior and took them to the UW police center in the stadium to issue citations.
According to the police report, both consumed beer before the game and were intoxicated when caught in the act. Breathalyzer tests show the male blew a .15 and the woman, a .16.
UW Assistant Police Chief Dale Burke said, ""While they were in the police center, the young man made the statement that they were only urinating together and the officer said well, it doesn't make any difference. You don't get to be in the women's restroom and you don't get to be in the same stall with your pants off.""
Before the two exited the stadium, Pehler noted that the young lady did acknowledge her sexual involvement with the male.
Verveer and Burke both could not recall a similar case at a UW sporting event.
""This is the first time in my memory that we've had a report of sex in the bathrooms at Camp Randall and I've been around twenty eight years,"" Burke said.
