Despite his loss to Gov. Jim Doyle last Tuesday, U.S. Rep. Mark Green, R-Green Bay, will continue his court battle over his campaign contributions.
The State Elections Board ordered Mark Green to return $467,844 in August, deeming the political action money from out of state illegal. Green then appealed to a circuit court and lost. After asking the state Supreme Court to hear his case, the high court said they would not decide to take up the case until after the Nov. 7 election.
The State Supreme Court said if Green wanted to continue his court case, he had to file a petition on Friday. Court records indicate the Green team did just that.
According to Don Millis, an attorney for Green, the outcome of the election will not affect their strategy
If the Supreme Court rules in Green's favor, Green will be able to use the $467,844 for the same purposes as any candidate, Millis said. The funds could be held for a future campaign, or donated to other candidates or charities.
If Green is ordered to divest the money, it will go back to donors,
to charity or to the common school fundâ_â_""a state fund for schools.
