In early July, the family of Detroy Marshall Sr. brought a case of wrongful death to the Appellate Court of Illinois against a Burger King restaurant.
The \wrongful death"" they claim for Marshall was caused when a car jumped a curb and crashed into a Burger King restaurant while the family was eating. The building was protected from the road by a brick wall that the restaurant had built only a few feet from the ground. The wall should have been built higher up to prevent accidents of this sort, the family said.
The Appellate Court ruled that the family could proceed with the case, even though the trial court had earlier dismissed the lawsuit, ruling that Burger Kings can't be expected to build fortresses against recklessly driven, airborne cars.
