According to the complaint, which was requested by the Department of National Resources, the company illegally deposited untreated septage from its toilets two to three times a week onto a nonagricultural field. The dumping allegedly occurred from at least May 2001 until September 2003.

The complaint additionally alleges Ace Portables used septic systems not designed for the waste it was acquiring, which would be both a violation of state statute and DNR regulation. Other alleged DNR infractions included insufficient record-keeping and operating without an operator-in-charge.
