Former state Senate Majority Leader Chuck Chvala, D-Madison, filed two motions Friday asking for the dismissal of the 20 felony counts he is charged with concerning his involvement in the caucus investigation.
One motion dealt with legal challenges to the criminal complaints concerning Chvala's supposed extortion, abuse of power and use of state employees for campaign work while they were still on sate time. The motion said Chvala is immune from prosecution due to a \privileged debate clause"" in the state Constitution. It also claims prosecution of Chvala would disregard the separation of powers.
The second motion attacks the involvement of Milwaukee County District Attorney E. Michael McCann and states the entire case should be thrown out due to McCann's conflict of interest.
Chvala, in the motion, maintained that McCann holds a grudge after Chvala helped defeat a constitutional amendment that would have increased the DA's term from two years to four years.
""In short, this 69-page single-spaced complaint was a mean-spirited political document written for the benefit of political enemies of Senator Chvala and for the media in an effort to politically assassinate Senator Chvala,"" the motion states.
